These Employer Terms & Conditions (“Terms”) govern the registration for and use of The Pool by employers.

By registering for an employer account, purchasing a membership or otherwise accessing or using The Pool, you confirm that you are authorised to act on behalf of the business you represent and agree to these Terms.

1. About The Pool

The Pool is an online platform that enables verified employers to discover and connect directly with potential candidates, including through candidate profiles, experience information, photographs, introduction videos and contact details.

The Pool facilitates connections between employers and candidates. Unless expressly stated otherwise, The Pool does not employ candidates, make hiring decisions on behalf of employers, manage employees or act as the employer of any candidate listed on the platform.

Employers remain responsible for their own recruitment and employment decisions.

2. Employer Registration & Verification

Access to The Pool is available to verified employers.

When registering, employers may be required to provide information including their registered business name, trading or brand names, contact details, CAC registration number and supporting business registration documentation.

Employers confirm that information and documents submitted to The Pool are accurate, current and relate to the business being registered.

The Pool may verify information submitted by an employer, request additional information or documentation, or decline, restrict or suspend access where we are unable to satisfactorily verify a business.

Verification by The Pool confirms only that we have completed our applicable employer verification process. It is not an endorsement, certification or guarantee of the employer.

3. Employer Accounts & Authorised Users

Employer access is provided for use by the registered business and its authorised representatives.

Employers must not provide platform access, passwords or other account credentials to individuals or organisations that are not authorised to recruit on behalf of the registered business.

Where multiple employees or representatives are permitted to use The Pool on behalf of an employer, the registered employer remains responsible for their use of the platform and compliance with these Terms.

4. Candidate Profiles

Candidate profiles may contain information including employment history, experience, photographs, introduction videos, salary expectations, availability, location and other information relevant to recruitment.

Some information may be provided directly by candidates, while certain information may be reviewed or verified by The Pool where expressly indicated on the candidate's profile.

Employers should not assume that information has been independently verified by The Pool unless the platform specifically states that it has been verified.

Candidate circumstances may also change. Employers should confirm any information that is important to their hiring decision directly with the candidate.

5. Candidate Information, Privacy & Videos

Candidate information made available through The Pool is provided solely for legitimate recruitment and hiring purposes.

Employers may share candidate information internally only with employees or authorised representatives who reasonably require access for the relevant recruitment process.

Candidate profiles, photographs, videos, CV information, telephone numbers, email addresses and other personal information obtained through The Pool must not be sold, published, publicly displayed, used for marketing, uploaded to unrelated databases or distributed to unauthorised third parties.

Candidate introduction videos must not be posted publicly, uploaded to social media, forwarded outside the employer's organisation, reproduced or otherwise distributed without the candidate's express permission.

Employers must take reasonable steps to protect candidate information from unauthorised access, disclosure or misuse.

Access to candidate information through The Pool does not transfer ownership of that information to the employer.

6. Contacting Candidates

Where an employer unlocks or otherwise receives a candidate's contact details, those details may be used to contact the candidate regarding legitimate employment opportunities associated with the employer's business.

An unlock does not mean that a candidate has agreed to interview with, work for or accept an offer from the employer.

Candidates remain free to respond or not respond to an employer and to accept or decline any interview, assessment, job opportunity or offer of employment.

Employers should communicate honestly and professionally with candidates regarding the role, employer, location, compensation and other material aspects of an opportunity.

7. Employer Hiring Responsibilities

Employers make their own hiring decisions and remain responsible for determining whether a candidate is suitable for employment.

Employers are responsible for conducting any interviews, reference checks, background checks, qualification checks, identity checks, right-to-work checks or other due diligence required or considered appropriate before employing a candidate.

Any verification or information provided by The Pool should not be treated as a substitute for an employer's own recruitment and employment procedures.

The Pool does not guarantee the accuracy or completeness of all candidate-provided information or guarantee a candidate's suitability, behaviour, performance or continued availability.

8. Employment Relationship

Where an employer hires or otherwise engages a candidate discovered through The Pool, the resulting employment or working relationship is solely between the employer and candidate.

The Pool does not manage or supervise employees and is not responsible for attendance, scheduling, performance management, compensation, disciplinary matters, grievances, termination, workplace disagreements or other day-to-day employment matters.

Employers remain responsible for complying with applicable employment, workplace, tax, immigration, health and safety and other legal obligations arising from their engagement of a candidate.

9. Professional Conduct

Employers using The Pool are expected to treat candidates fairly, professionally and with respect throughout the recruitment process and any subsequent engagement.

Employers must not use The Pool to facilitate harassment, discrimination, exploitation, threats, violence, abuse, fraudulent recruitment practices or other unlawful or seriously inappropriate conduct.

Employers must not request payment from a candidate in exchange for accessing a job opportunity obtained through The Pool unless such payment is expressly lawful and clearly unrelated to The Pool's recruitment process.

The Pool reserves the right to restrict or terminate access where we reasonably believe an employer's conduct presents a serious risk to candidates or the integrity of The Pool network.

10. Serious Incident Reporting

The Pool does not manage routine workplace disputes, performance matters or disciplinary issues between employers and candidates.

Routine matters such as lateness, performance concerns, resignation, interpersonal disagreements or ordinary workplace disciplinary matters should be managed directly between the employer and candidate.

Employers may notify The Pool of serious safety, security or integrity concerns involving a candidate. These may include credible allegations involving violence or threats of violence, sexual misconduct, theft, fraud, falsification of identity or documents, or other conduct that may present a serious risk to another person or the integrity of The Pool network.

Candidates may similarly report serious safety, security or integrity concerns involving employers.

Submission of a report does not automatically result in suspension or removal of an employer or candidate. The Pool may review information provided, request additional information where appropriate and determine whether any action concerning access to or participation in The Pool is warranted.

The Pool is not an investigative, judicial, law enforcement or disciplinary body and does not determine criminal or civil liability.

Where a matter involves immediate danger, suspected criminal activity or circumstances requiring formal investigation, the relevant party should contact the appropriate authorities.

11. Memberships, Access & Contact Unlocks

Access to certain features of The Pool may require an active paid employer membership.

Memberships, contact unlock allowances and any additional services are provided according to the pricing and conditions communicated at the time of purchase.

Included contact unlocks may be subject to limits and reset periods associated with the applicable membership.

Unlocking a candidate's contact information constitutes use of an unlock regardless of whether the candidate ultimately responds, interviews with or is hired by the employer, except where The Pool determines that an unlock was caused by a technical error or other exceptional circumstance.

Additional unlocks or other services may have separate validity periods or usage conditions, which will be communicated when purchased.

The Pool may amend its pricing, membership structures and product features from time to time. Changes will not retrospectively alter a membership period already paid for unless otherwise agreed.

12. No Guarantee of Hiring Outcome

Membership of The Pool provides access to recruitment tools and potential candidates. It does not guarantee that an employer will receive a particular number of applications, interviews, responses or successful hires.

The Pool does not guarantee that a particular candidate will remain available, respond to contact, attend an interview, accept an offer or remain employed after being hired.

Recruitment and employment decisions remain between the employer and candidate.

13. Misuse of The Pool

Employers must not use The Pool to:

• collect candidate information for purposes unrelated to genuine recruitment;

• systematically copy, scrape, download or build a separate database from candidate information;

• sell or provide access to candidate information to another business or recruitment service;

• publicly distribute candidate photographs, videos or personal information;

• impersonate another person or business;

• provide false or misleading employer information;

• circumvent contact unlock limits or other platform access controls; or

• use The Pool for fraudulent, unlawful, abusive or exploitative purposes.

The Pool may investigate suspected misuse and may restrict, suspend or terminate access where reasonably necessary to protect candidates, employers, the platform or The Pool network.

14. Suspension or Termination of Employer Access

The Pool may suspend, restrict or terminate an employer's access where the employer materially breaches these Terms, misuses candidate information, provides fraudulent or materially inaccurate registration information, fails to make payments when due, compromises platform security or engages in conduct that may seriously harm candidates or The Pool network.

Where reasonably practicable, The Pool may contact the employer regarding the issue before taking permanent action. However, immediate restriction or suspension may be imposed where necessary to protect candidates, personal information, platform security or other users.

Termination or suspension does not remove obligations concerning candidate information already obtained through The Pool.

15. Limitation of Responsibility

The Pool facilitates introductions and access to candidate information but does not control the actions of employers or candidates.

To the extent permitted by applicable law, The Pool is not responsible for the acts or omissions of candidates or employers, employment decisions, workplace conduct, employment performance, employment disputes or losses arising solely from the employment or engagement relationship between an employer and candidate.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

16. Data Protection & Privacy

The Pool processes personal information in accordance with its Privacy Policy and applicable data protection requirements.

Employers accessing candidate personal information through The Pool are responsible for handling that information lawfully, securely and solely for legitimate recruitment and employment purposes.

Employers should retain candidate information only for as long as reasonably necessary for the relevant recruitment or employment purpose, subject to any applicable legal obligations.

17. Intellectual Property

The Pool name, branding, website design, platform content and other materials created by The Pool remain the property of The Pool or its applicable licensors.

Access to The Pool does not grant employers ownership of the platform, candidate profiles or other Pool content.

Employers grant The Pool permission to use company names, trading names or logos only where the employer has separately provided the relevant permission or where their use is reasonably necessary for administration of the employer's account.

Optional marketing permissions requested during employer registration are not a condition of membership unless expressly stated otherwise.

18. Changes to These Terms

The Pool may update these Terms from time to time as the platform, services or applicable requirements evolve.

The current version will be published on The Pool website together with the date it was last updated.

Where a change materially affects an employer's existing membership or use of the platform, The Pool may provide reasonable notice where appropriate.

Continued use of The Pool following the effective date of updated Terms constitutes acceptance of those Terms.

19. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any dispute relating to these Terms or use of The Pool will be subject to applicable Nigerian law and the jurisdiction of the appropriate courts in Nigeria, unless the parties agree to another lawful method of dispute resolution.
