Welcome to The Pool Platform, operated by The Pool Ventures Ltd ("the pool," "Company," "we," "us," and "our"), a company duly registered as a private company limited by shares under the Companies and Allied Matter Act 2020 with  RC Number 7110713.

These guidelines outline how to use our platform effectively and responsibly. Please read these Guidelines to ensure a positive and respectful experience for all users. Also read these Guidelines in conjunction with our Terms and Conditions and Privacy Policy (collectively referred to as the "Terms of Use"). Defined terms within these Guidelines carry the meanings ascribed to them in the Terms of Use.

 

About The Pool Platform

Our principal business activity is to engage in the development, operation, and management of a website known as 'The Pool,' primarily designed for recruitment purposes and targeted at African markets.

 The Pool Platform serves as a marketplace connecting recruiters and potential employees, a social community where Users engage within their respective industries, a hub for upskilling courses and content, and offers services aimed at improving employment access in Nigeria and Africa. When you register on The Pool Platform, you become a member and may automatically gain access to various groups. You may also choose to participate in additional communities aligned with your interests. Our diverse user base necessitates the implementation of strict guidelines to ensure a standardized practice and foster a secure environment for open expression. These guidelines are not exhaustive, and we retain the discretion to determine what content violates the Terms of Use and how we address such violations.

We reserve the right to modify these Guidelines at any time.

 

Compliance with Applicable Law

All content must comply with applicable laws. Registered Users are responsible for ensuring that their uploaded content adheres to and aligns with applicable legal standards. Content that threatens the unity, integrity, defense, security, or sovereignty of Nigeria, disrupts friendly relations with foreign States, or compromises public order is strictly prohibited. Users may not engage with content that insults or disrespects other nations, incites criminal activities, or obstructs investigations into crimes. We reserve the right to cancel any account at any time that violates our guidelines. Business and Candidate profile and video content are always subject to The Pool’s review and approval. Approval can also be revoked if later content is deemed inappropriate.

 

Zero Tolerance Policy

The Pool Platform maintains a Zero Tolerance Policy towards:

• Discriminatory content or behavior based on age, sex, gender identity and expression, religion, caste, ethnicity, community, disability, nationality, race, immigration status, sexual orientation, victims of a major violent event and their kin.
• Content promoting hate or violence against individuals or groups, irrespective of the aforementioned attributes.
• Content related to organized crime, criminal activities, promotion/sale/use of weapons, firearms and explosives, violence or terrorist activities.
• Sale of illegal goods or services, regulated goods, drugs and controlled substances, soliciting or selling sexual services.
• Content that encourages dangerous challenges or pranks.
• Content that harasses, harms, or abuses children.
• Content related to or encouraging money laundering or gambling.
• Content that is misleading, false, or disseminates misinformation.
• Content providing tutorials or instructions for illegal activities or activities that harm or endanger individuals or groups.
• Harassment or bullying through abusive language or curse words.
• Posting false information to harass someone for financial gain or cause harm.
• Harassment or cyberbullying, including name-calling or malicious insults based on someone's attributes, including physical appearance.
• Content that encourages self-harm, abuse, or suicide.
• Animal abuse.
• Content related to Multi-Level Marketing/direct marketing/network marketing/digital marketing.
• Links promoting referral-based earnings or online games.
• Fake or fraudulent job openings and engagements.
• Nudity, Pornography, and Sexually Explicit Content
  • The Pool Platform strictly prohibits nudity, pornography, and any form of sexually explicit content. This includes, but is not limited to:
  • Obscene, sexually explicit, pornographic material or images/videos revealing private body parts or depicting sexual activities.
  • Videos or images of individuals in compromising positions or content with explicit sexual content or intent.
  • Sextortion or revenge pornography.
  • Bestiality or zoophilia, whether explicit or implied.
  • Necrophilia, whether explicit or implied.
  • Content that exploits or endangers any person, including sharing personal information for exploitation or endangerment, such as encouraging prostitution or escort services.
  • Content related to child pornography, pedophilia, or indecent material involving minors.

 

Respect for Intellectual Property

Content should not infringe upon the intellectual property rights of third parties. This includes:

• Literary, musical, dramatic, artistic, sound recordings, cinematographic works.
• Content that is not original and is copied from individuals/organizations owning the intellectual property rights.
• Content displaying a logo, trademark, trade name, or any other identifiers of a third party without their consent.
• Content found to violate third-party intellectual property rights will be removed. Users repeatedly posting infringing content may face suspension or a permanent ban from The Pool Platform.

Non-Consensual Content

Posting content, data, or information of another person, including their pictures or videos, without obtaining prior consent to use such content on The Pool Platform is strictly prohibited. Users may not share personally identifiable information or photographs/videos of others without their explicit permission or consent. Content that invades someone's privacy will be promptly removed, and users repeatedly posting such content may lose access to The Pool Platform.

 

Responsibility of Background Checks

• User Responsibility: Users of The Pool Platform are responsible for conducting background checks on potential candidates or employers as they deem necessary. The Pool Platform does not perform background checks on its users, and users should exercise due diligence and caution when considering employment or engagement with other users.

• Third-Party Services:Users may choose to use third-party background check services or other verification methods to assess the qualifications and suitability of candidates or employers. The Pool Platform does not endorse or guarantee the accuracy or reliability of third-party services and disclaims any liability related to their use.

• Platform Facilitation:The Pool Platform provides a platform for users to connect and interact but does not act as an intermediary for conducting background checks. Users are solely responsible for verifying the accuracy of information provided by other users and should seek additional information or references when necessary.

• Transparency and Disclosure:Users are encouraged to be transparent about their qualifications, work history, and background when creating profiles or interacting with others on the platform. Any misrepresentation or omission of important information may violate the Community Guidelines and Terms of Use.

• Reporting Concerns:If users encounter suspicious or inappropriate behavior during their interactions on The Pool Platform, they are encouraged to report such concerns to the platform's moderation team. While the platform may take actions to address violations of the Community Guidelines, users should exercise caution and judgment in their interactions.

• Disclaimer:The Pool Platform disclaims any liability related to the accuracy, completeness, or timeliness of information provided by users or third-party services. Users acknowledge that conducting background checks is their responsibility and that the platform is not a substitute for thorough due diligence.

 

Limitation of Liability

While we strive to maintain a safe and respectful environment on The Pool Platform, we want to make it clear that we are not responsible for the actions or content of our users. By using The Pool Platform, you agree to the following:

• User Responsibility:Users are solely responsible for their actions and the content they post on the platform. The Pool does not endorse, guarantee, or vouch for the accuracy, reliability, or legality of any user-generated content. Users should exercise caution and discretion when interacting with others and when relying on information obtained through the platform. 

• No Warranty:The Pool makes no warranties or representations about the platform's accuracy or reliability. We provide the platform on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

• No Liability for User Actions:The Pool shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

 

1. Violations of these Community Guidelines by users.
2. Inaccuracies or errors in user-generated content.
3. Any user's reliance on information obtained through the platform.
4. Any interruption, suspension, or termination of the platform's services.

 

Indemnification: Users agree to indemnify and hold The Pool and its affiliates, officers, employees, and agents harmless from any claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with their use of the platform, violation of these Community Guidelines, or violation of any rights of another person or entity.

Jurisdiction: These Community Guidelines and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of Nigeria. Any legal action or proceeding relating to these guidelines shall be brought exclusively in the courts of Nigeria.

By using The Pool Platform, you acknowledge and accept these limitations of liability. If you do not agree with these terms, please refrain from using our platform.

 

Reporting

While Pool makes every effort to moderate content in compliance with the Terms of Use and these Guidelines, we may not always identify violative content. Therefore, we rely on our Users to report content that may breach the Terms of Use and these Guidelines. We encourage you to report posts that potentially violate the Terms of Use or these Guidelines.
